Terms of Use

Acceptance of the Terms of Use

These terms of use are entered into by and between the natural person or business accepting these terms and using the services here established (the “User”) and DUDI SPORTS TECHNOLOGIES FZE (“DUDI“). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Use“), govern the User’s access to and use of DUDI SPORTS TECHNOLOGIES FZE’s Dudi App (the “App“), including any content, functionality, and services offered on or through the App, whether as a guest or a registered user.

The User must read the Terms of Use carefully before the User starts to use the App. By using the App or by clicking to accept or agree to the Terms of Use when this option is made available to the User, the User accepts and agrees to be bound and abide by these Terms of Use. If the User does not want to agree to these Terms of Use, the User must not access or use the App.

Age Requirement

This App is offered and available to users who are 12 years of age or older. By using this App, the User represents and warrants that the User is of legal age to form a binding contract with DUDI and meets all of the foregoing eligibility requirements. If the User does not meet all of these requirements, the User must not access or use the App.

The App

DUDI is an all sports marketplace with a mission to connect sports enthusiasts and empower sports communities; the App is an all-sports mobile application, whether the User wants to play football, train with a personal trainer, go scuba diving or find a group to go hiking with, the App will help the User do all types of sports activities. Any sports and wellness related businesses, freelancers or influencers, can setup a business profile in the App.

The App will help the User to:

  • Unlock network effects
  • Eliminate friction using multiple platforms
  • Speed up transaction process
  • Reduce transaction cost
  • Focus more on the real work
  • Generate more revenues

Changes to the Terms of Use

DUDI may revise and update these Terms of Use from time to time in its sole discretion. All changes are effective immediately when DUDI posts them, and apply to all access to and use of the App thereafter.

The User’s continued use of the App following the posting of revised Terms of Use means that the User accepts and agrees to the changes. The User is expected to check this page from time to time so the User is aware of any changes, as they are binding on the User.

Accessing the App

DUDI reserves the right to withdraw or amend this App, and any service or material DUDI provides on the App, in its sole discretion without notice. DUDI will not be liable if for any reason all or any part of the App is unavailable at any time or for any period. From time to time, DUDI may restrict access to some parts of the App, or the entire App, to Users, including registered users.

The User is responsible for both:

  • Making all arrangements necessary for the User to have access to the App.
  • Ensuring that all persons who access the App through the User’s account are aware of these Terms of Use and comply with them.

To access the App or some of the resources it offers, the User may be asked to provide certain registration details or other information. It is a condition of the User’s use of the App that all the information the User provides on the App is correct, current, and complete. The User agrees that all information they provide to register with this App or otherwise, including, but not limited to, through the use of any interactive features on the App, is governed by DUDI’s privacy policy which is incorporated as an annex to these terms (“Privacy Policy”).

Account Security

If the User chooses, or is provided with, a user name, password, or any other piece of information as part of DUDI’s registration process, the User must treat such information as confidential, and the User must not disclose it to any other person or entity. The User also acknowledges that their account is personal and agrees not to provide any other person with access to this App or portions of it using the User’s user name, password, or other security information. The User agrees to notify DUDI immediately of any unauthorized access to or use of the User’s user name or password or any other breach of security. The User also agrees to ensure that the User exit from the User’s account at the end of each session. The User should use particular caution when accessing the User’s account from a shared device so that others are not able to view or record the User’s password or other personal information.

DUDI has the right to disable any user name, password, or other identifier, whether chosen by the User or provided by DUDI, at any time in DUDI’s sole discretion for any or no reason, including if, in DUDI’s opinion, the User has violated any provision of these Terms of Use.

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by DUDI, its licensors, or other providers of such material and are protected by any applicable law and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit the User to use the App for the User’s personal, non-commercial use only. The User hereby accepts that the permission to use the App, at no time and under no circumstances will be interpreted as a transfer of rights and any other analogies of the rights that DUDI possess on the App, even for personal use. The User must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the App, except as follows:

  • The User’s device may temporarily store copies of such materials incidental to the User accessing and viewing those materials.
  • The User may store files that are automatically cached by the User’s device for display enhancement purposes.
  • The User may download a single copy of the App solely for the User’s own personal, non-commercial use, provided the User agrees to be bound by DUDI’s terms.
  • If we provide social media features with certain content, the User may take such actions as are enabled by such features.

The User must not:

  • Modify copies of any materials from the App.
  • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this App.

The User must not access or use for any commercial purposes any part of the App or any services or materials available through the App.

If the User prints, copies, modifies, downloads, or otherwise uses or provides any other person with access to any part of the App in breach of the Terms of Use, the User’s right to use the App will stop immediately and the User must, at DUDI’s option, return or destroy any copies of the materials the User has made. No right, title, or interest in or to the App or any content on the App is transferred to the User, and all rights not expressly granted are reserved by DUDI. Any use of the App not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws. These provisions and any other clauses related in these terms to Copyright, are for the benefit of DUDI, its subsidiaries, affiliates and its third party content providers.

Trademarks

DUDI’s name, DUDI’s logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DUDI or its affiliates or licensors. The User must not use such marks without the prior written permission of DUDI. All other names, logos, product and service names, designs, and slogans on this App are the trademarks of their respective owners.

Copyright and Trademark Infringement.

DUDI will use all possible legal means to prosecute any infringement of its Copyrights and Trademarks. The User will be held liable for any damage or infringement and must, in addition to providing economic compensation, immediately terminate any action that violates the rights of DUDI.

Cancellations Policy

Cancellations to contracted activities are allowed only 48 hours before the date and time of the activity. No refunds will be made if the activity was cancelled after 48 hours from the date and time of the activity.

Safety and Health Measures

DUDI provides its App as a platform to be used by Users and third parties. However, DUDI, under no circumstances will be liable for the activities performed by the Users, even when they have been contracted through the App. Each User, both the one providing the activities and the one performing the activities, will be responsible for complying the safety measures, health measures, biosecurity measures and all applicable insurance policies, both required by law and those recommended for good practices for the type of activity to be carried out.

The Users accept that they use and will perform the activities contracted through the App, under their own risk and responsibility. Users who have any special health condition, including pregnant women, must be aware of their risk and ensure that they are physically fit to perform the activities contracted in the App.

Licenses and Qualifications

Users providing, buying and performing activities, accept that DUDI will not be liable at any time for the activities contracted through the App. Users providing the activities are responsible for their own certifications and legal requirements required to provide the activities.

 

Prohibited Uses

The User may use the App only for lawful purposes and in accordance with these Terms of Use. The User agrees not to use the App:

  • In any way that violates any applicable federal, state, local, or international law or regulation and the Dubai International Financial Centre (DIFC) rules and regulations.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
  • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the standards set out in these Terms of Use.
  • To transmit, or procure the sending of, any advertising or promotional material without DUDI’s prior written consent.
  • To impersonate or attempt to impersonate DUDI, a DUDI employee, another User, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by DUDI, may harm DUDI or Users of the App, or expose them to liability.
  • To promote sexually explicit or pornographic material, violence, drug trafficking, terrorism, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

Additionally, the User agrees not to:

  • Use the App in any manner that could disable, overburden, damage or interfere with any other party’s use of the App, including their ability to engage in real time activities through the App.
  • Use any robot, spider, or other automatic device, process, or means to access the App for any purpose, including monitoring or copying any of the material on the App.
  • Use any manual process to monitor or copy any of the material on the App, or for any other purpose not expressly authorized in these Terms of Use, without DUDI’s prior written consent.
  • Use any device, software, or routine that interferes with the proper working of the App.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
  • Attack the App via a denial-of-service attack or a distributed denial-of-service attack.
  • Otherwise attempt to interfere with the proper working of the App.

User Contributions

The App may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, “Interactive Services“) that allow Users to post, submit, publish, display, or transmit to other Users or other persons (hereinafter, “post“) content or materials (collectively, “User Contributions“) on or through the App.

All User Contributions must comply with the standards set out in these Terms of Use.

Any User Contribution posted to the App will be considered non-confidential and non-proprietary. By providing any User Contribution on the App, the User grants DUDI and its licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.

The User represents and warrants that:

  • The User owns or controls all rights in and to the User Contributions and has the right to grant the license granted above to DUDI and licensees, successors, and assigns.
  • All of the User Contributions do and will comply with these Terms of Use.

The User understands and acknowledges that the User is responsible for any User Contributions the User submits or contributes, and the User, not DUDI, has full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

DUDI not responsible or liable to any third party for the content or accuracy of any User Contributions posted by the User or any other user of the App, will be considered non-confidential and non-proprietary.

Content Standards

These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

  • Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
  • Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
  • Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use.
  • Be likely to deceive any person.
  • Promote any illegal activity, or advocate, promote, or assist any unlawful act.
  • Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.
  • Impersonate any person, or misrepresent the User’s identity or affiliation with any person or organization.
  • Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising.
  • Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

Reliance on Information Posted

The information presented on or through the App is made available solely for general information purposes. DUDI does not warrant the accuracy, completeness, or usefulness of this information. Any reliance the User places on such information is strictly at the User’s own risk. DUDI disclaims all liability and responsibility arising from any reliance placed on such materials by the User or any other visitor to the App, or by anyone who may be informed of any of its contents.

This App may include content provided by third parties, including materials provided by other users, bloggers, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by DUDI, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of DUDI. DUDI is not responsible, or liable to the User or any third party, for the content or accuracy of any materials provided by any third parties.

Monitoring and Enforcement; Termination

DUDI has the right to:

  • Remove or refuse to post any User Contributions for any or no reason in its sole discretion.
  • Take any action with respect to any User Contribution that DUDI deems necessary or appropriate in its sole discretion, including if DUDI believes that such User Contribution violates the Terms of Use, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of Users of the App or the public, or could create liability for DUDI.
  • Disclose the User’s identity or other information about the User to any third party who claims that material posted by the User violates their rights, including their intellectual property rights or their right to privacy.
  • Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the App.
  • Terminate or suspend the User’s access to all or part of the App for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, DUDI has the right to cooperate fully with any law enforcement authorities or court order requesting or directing DUDI to disclose the identity or other information of anyone posting any materials on or through the App. THE USER WAIVES AND HOLDS HARMLESS DUDI AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY DUDI DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER DUDI OR LAW ENFORCEMENT AUTHORITIES.

However, DUDI does not undertake to review material before it is posted on the App, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, DUDI assumes no liability for any action or inaction regarding transmissions, communications, or content provided by any User or third party. DUDI has no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

Changes to the App

DUDI may update the content on this App from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the App may be out of date at any given time, and DUDI is under no obligation to update such material.

Information About The User and The User’s Visits to the App

All information DUDI collects on this App is subject to the Privacy Policy. By using the App, the User consent to all actions taken by us with respect to the User’s information in compliance with the privacy policy.

Online Purchases and Other Terms and Conditions

All payments, packages, promotional codes and purchases through the App or other transactions for the sale of services, or information formed through the App, or resulting from visits made by the User, are governed by DUDI’s conditions.

Additional terms and conditions may also apply to specific portions, services, or features of the App.

Disclaimer of Warranties

The User understands that DUDI cannot and does not guarantee or warrant that files available for downloading from the App will be free of viruses or other destructive code. The User is responsible for implementing sufficient procedures and checkpoints to satisfy the User’s particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to DUDI site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, DUDI WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT THE USER’S DEVICE, SOFTWARE PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO THE USER’S USE OF THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP OR TO THE USER’S DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY SITE LINKED TO IT.

THE USER’S USE OF THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP IS AT THE USER’S OWN RISK. THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER DUDI NOR ANY PERSON ASSOCIATED WITH DUDI MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP. WITHOUT LIMITING THE FOREGOING, NEITHER DUDI NOR ANYONE ASSOCIATED WITH DUDI REPRESENTS OR WARRANTS THAT THE APP, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT DUDI’s SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL OTHERWISE MEET THE USER’s NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, DUDI HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL DUDI, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USER’s USE, OR INABILITY TO USE, THE APP, ANY SITES LINKED TO IT, ANY CONTENT ON THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

The limitation of liability set out above does not apply to liability resulting from DUDI’s gross negligence or willful misconduct.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

The User agrees to defend, indemnify, and hold harmless DUDI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to the User’s violation of these Terms of Use or the User’s use of the App, including, but not limited to, the User Contributions, any use of the App’s content, services, and products other than as expressly authorized in these Terms of Use, or the User’s use of any information obtained from the App.

Governing Law and Jurisdiction

All matters relating to the App and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with Dubai International Financial Centre (DIFC) rules and regulations..

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the App shall be instituted exclusively in arbitration set in Dubai International Financial Center (DIFC), although DUDI retains the right to bring any suit, action, or proceeding against the User for breach of these Terms of Use in the User’s country of residence or any other relevant country in any court or arbitration. The User waives any and all objections to the exercise of jurisdiction over the User by such courts and to venue in such courts.

Waiver and Severability

No waiver by DUDI of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of DUDI to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use constitute the sole and entire agreement between the User and DUDI regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App. These terms will remain valid until DUDI deems it convenient and while the User uses the App. These terms will be effective from the time the User registers and begins to use the App.

 

ANNEX

Privacy Policy

  1. INFORMATION COLLECTION

When the User uses the App, the User may provide DUDI with information about the User. This may include the User’s name and contact information, financial information to make or receive payment for services obtained through the App. When the User uses the App, DUDI may also collect information related to the use of the App and aggregate this with information about other Users. The User may also provide DUDI with information about the User’s contacts or friends.

  • Personal Information: In the course of using the App whether, DUDI may require or otherwise collect information and/or documentation that identifies the User as a specific individual and any information and/or documentation concerning an identified or identifiable natural person, and that can be used to contact or identify the User (“Personal Information”). Examples of Personal Information may include the User’s name, email address, company address, billing address, photographs, Identification documents and phone number.
  • Payment Information: If the User uses the App to make or receive payments, DUDI will also collect certain payment information, such as credit card or other financial account information, and billing address.
  • Biometric Identifiers or App Interaction Information: DUDI may collect Personal Information such as a photograph of the User’s face, a selfie, or data about the User’s interactions with the App to verify the User’s identity and to detect fraud, identity theft, or other misuse of the User’s account through the use of facial recognition and other technologies. DUDI may request documents to verify this information, such as a copy of the User’s government-issued identification. From time to time, DUDI may require the User to take and submit an additional or updated image of the User’s face for comparison to the User’s government-issued identification. The biometric identifiers or information collected are used only for identity verification and App security and use integrity purposes.
  • Non-Identifying Information/Usernames: DUDI also may collect other information, such as zip codes, demographic data, information regarding the User’s use of the App, and general project-related data (“Non-Identifying Information”). DUDI may aggregate information collected from registered and non-registered Users. In some cases, DUDI may render Personal Information (generally, email address) into a form of Non-Identifying Information referred to in this Privacy Policy as “Hashed Information.” This is typically accomplished using a mathematical process (commonly known as a hash function) to convert information into a code. The code does not identify the User directly, but it may be used to connect the User’s activity and interests.
  • Combination of Personal and Non-Identifying Information: Certain Non-Identifying Information would be considered a part of the User’s Personal Information if it were combined with other identifiers in a way that enables the User to be identified (for example, combining information with the User’s name). But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information. DUDI may combine the User’s Personal Information with Non-Identifying Information, but DUDI will treat the combined information as Personal Information.
  1. User Profiles

The User may have the opportunity to create a profile, which consists of information about the User, and may include Personal Information, photographs, education, skills, tests taken, test scores, hourly pay rates and earnings information, feedback/rating information and other information, including the User’s username (“Profile”). The information in the User Profile may be visible to all Users and the general public subject to the privacy choices the User make within the Profile. The User may edit certain information in the Profile via the User’s account and may choose to limit who is able to view certain content.

  1. Identity Verification

DUDI may take steps to verify the User’s identity. Before a User can complete registration on the App, or at any time thereafter, DUDI may request or re-request identity verification. Without limiting the manner in which DUDI request identify verification, DUDI may require Users to participate in a video call after submitting their government issued ID to enable DUDI to confirm that the User is indeed the individual in the ID. DUDI may record such video calls and take screenshots of the user during the call. DUDI may use the information obtained from Identity Verification for purposes of verifying the User’s identity, enforcing the Terms of Use and other agreements, and preventing fraud.

  1. Messaging

Users may communicate with each other through the App. DUDI does not control User’s collection or use of the shared information.

  1. Feedback

DUDI collect public and private feedback from Users about their experience with the App. Please note that any public feedback that the User provide via the App about the User’s experience with other Users or that is provided about the User by other Users is publicly viewable via the App. DUDI uses this information to respond to the User’s inquiries, improve the App and, and develop new products and features.

  1. USE OF INFORMATION

DUDI uses information collected through the App to:

  1. Provide and improve the App, process the User’s requests, prevent fraud, provide the User with information and advertising that may interest the User, comply with the law, and as otherwise permitted with the User’s consent.
  2. Provide and improve the App, complete the User’s transactions, address the User’s inquiries, process the User’s registration, verify the information the User provide is valid, and for compliance and internal business purposes.
  3. To administer and develop business relationship with the User and, if applicable, the corporation or other legal entity the User represent.
  4. To enforce and comply with the law, including to conduct an investigation, to protect the property and rights of DUDI or a third party, to protect the safety of the public or any person, or to prevent or stop activity DUDI may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity.
  5. DATA RETENTION

Unless the User requests that DUDI deletes certain information, DUDI retains government-issued identification documents the User submit to verify the User’s identity for 30 days, selfies the User submit to verify the User’s identity for 180 days, a copy of the headshot image from the User’s identity document for 3 years, and other information DUDI collects for at least 5 years. The User’s information may persist in copies made for backup and business continuity purposes for additional time. If the User chooses to provide DUDI with Personal Information, DUDI encourages the User to routinely update the data to ensure that DUDI has accurate and up-to-date information about the User.

The User can review and change the User’s Personal Information by logging into the Site and visiting the User’s account profile page.

DUDI will not be obliged to delete the Personal Information when:

  • It refers to the parties of a private, social or administrative contract and it is necessary for its development and compliance;
  • It must be treated by legal provision;
  • It obstructs judicial or administrative actions related to tax obligations, the investigation and prosecution of crimes or the updating of administrative sanctions;
  • Is necessary to protect the legally protected interests of its owner;
  • Is necessary to carry out an action based on the public interest;
  1. LEGAL AND INVESTIGATIVE PURPOSES:

DUDI will share information with government agencies as required by law in response to lawful requests by public authorities, including to meet national security or law enforcement requirements and, including without limitation, in connection with reporting earnings. DUDI cooperates with government and law enforcement officials and private parties to enforce and comply with the law. DUDI will disclose information about the User to government or law enforcement officials or private parties as DUDI, in its sole discretion, believes necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), or, at the request of governmental authorities or other third parties conducting an investigation where DUDI determines in its sole discretion the disclosure is necessary to (a) protect the property and rights of DUDI or a third party, (b) protect the safety of the public or any person, or (c) prevent or stop activity DUDI may consider to be, or pose a risk of being, illegal, fraudulent, unethical or legally actionable activity. These provisions will remain in effect even if DUDI sells or assigns its rights to the App.

  1. CHANGES TO THIS POLICY

DUDI may change this Privacy Policy. If DUDI makes substantial changes, DUDI will provide notice.

DUDI may update this Privacy Policy at any time and any changes will be effective upon posting. In the event that there are substantial changes to the way DUDI treat the User’s Personal Information, DUDI will display a notice through the App prior to the change becoming effective. DUDI may also notify the User by email. However, DUDI will use the User’s Personal Information in a manner consistent with the Privacy Policy in effect at the time the User submitted the information, unless the User consents to the new or revised policy.
